Terms of Service

These Terms of Service govern your use of Brivio, an educational technology platform for language teachers and students. Please read them carefully before using the service.
Acceptance of Terms
These Terms of Service ("Terms") form a legally binding agreement between you (or, if you are a school or district, your institution) and BRIVIO HQ LLC ("Brivio," "we," "us"). By accessing or using Brivio, you agree to be bound by these Terms and our Privacy Policy.
If you are a teacher, administrator, or school representative agreeing on behalf of your school or district, you represent that you have the authority to bind your institution to these Terms.
If you do not agree to these Terms, do not use Brivio.
Educational Use
Brivio is an educational technology service designed for use in world language and foreign language classrooms. It helps teachers design proficiency-based tasks, collect student work, provide feedback, and track language development over time.
Brivio is intended for educational purposes only. It is not a consumer social network, a general-purpose messaging platform, or a grading automation tool. The teacher's professional judgment remains at the center of every instructional decision.
Accounts and Roles
Brivio uses three primary account roles:
- Teacher / School Administrator — creates and manages classes, designs tasks, reviews student work, and provides feedback. Teachers are responsible for appropriate use within their classes.
- Student — joins classes assigned by a teacher, completes tasks, submits work, and receives feedback. Students must be enrolled in a class to use the service.
- School / District — an institution that deploys Brivio for its teachers and students under a school or district agreement.
Each user is responsible for maintaining the confidentiality of their account credentials and for all activity under their account. Notify us promptly at [Contact email] if you suspect unauthorized access to your account.
School and Teacher Responsibilities
Teachers and school administrators who use Brivio agree to:
- Use Brivio only for lawful educational purposes consistent with their school or district's policies.
- Obtain any required permissions or parental consents before enrolling students, including students under 13.
- Ensure that class content and tasks are appropriate for students.
- Not share login credentials or allow unauthorized individuals to access the platform.
- Promptly remove student accounts when students are no longer enrolled in a class.
- Comply with applicable federal and state laws governing student privacy, including FERPA and, where applicable, COPPA.
Student Users
Students join Brivio through a class code provided by their teacher. Students may only access their own class, their own submitted work, and feedback provided by their teacher.
Students under 13 may only use Brivio through a school account where the school has obtained appropriate parental consent. Brivio does not knowingly collect personal information directly from children under 13 outside of the school context.
Students agree to use Brivio respectfully and in accordance with their teacher's instructions. Submitting false, harmful, or inappropriate content is prohibited.
User Content and Student Work
"User Content" means any content — including written responses, spoken audio, uploaded files, and teacher feedback — that users submit to Brivio.
Ownership: Users retain ownership of their User Content. Student work belongs to the student (and, where applicable, the school). Teacher-created tasks and feedback belong to the teacher or their school. Brivio does not claim ownership of User Content.
License to operate: By submitting User Content, you grant Brivio a limited, non-exclusive license to store, process, and display that content solely to provide the service to you and your school. This license does not extend to commercial use, resale, or advertising.
Student work: Student submissions are treated as education records where applicable (see our Privacy Policy). They are visible to the student's teacher and, in some cases, the school administrator. They are not shared publicly.
AI features: Where Brivio uses AI assistance (for example, optional instructional support features), student work submitted to those features is used only to generate in-session responses and is not used to train AI models.
Acceptable Use
You agree not to:
- Use Brivio for any unlawful purpose or in violation of any applicable law or regulation.
- Post or transmit content that is harassing, defamatory, discriminatory, obscene, or otherwise harmful.
- Attempt to gain unauthorized access to any account, server, or system associated with Brivio.
- Scrape, crawl, or systematically download data from Brivio without our written permission.
- Interfere with or disrupt the integrity or performance of the service.
- Reverse engineer, decompile, or disassemble any part of the Brivio platform.
- Use the service to impersonate any person or entity.
- Upload or transmit malicious code, viruses, or other harmful software.
- Use student data for any commercial purpose.
We reserve the right to suspend or terminate accounts that violate these Terms.
Privacy
Your use of Brivio is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, and protect personal information, including student data, and how we handle data received through Google sign-in.
Third-Party Services, Including Google Sign-In
Brivio integrates with third-party services to deliver the platform. These include:
- Google Sign-In (OAuth 2.0) — for account authentication. When you sign in with Google, you are also subject to Google's Terms of Service and Privacy Policy. Brivio requests only the minimum scopes needed for authentication and does not access Google services beyond basic profile and email.
- Wix.com — platform infrastructure and hosting.
- OpenAI — optional AI-assisted features (where enabled).
Brivio is not responsible for the practices of these third-party services. We encourage you to review their respective privacy policies.
Brivio's use of information received from Google APIs complies with the Google API Services User Data Policy, including the Limited Use requirements.
Service Availability and Changes
We strive to keep Brivio available and reliable, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We may modify, update, or discontinue features of Brivio at any time. We will provide reasonable notice of material changes that affect school or teacher use. Continued use of Brivio after changes take effect constitutes acceptance of the updated Terms.
Termination
Either party may terminate use of the service at any time. Teachers may delete their account through platform settings. Schools may contact us to terminate their institution's access.
We may suspend or terminate accounts that violate these Terms, with or without prior notice depending on the severity of the violation. Upon termination, data deletion will be handled in accordance with our Privacy Policy.
Disclaimers
Brivio is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Brivio does not guarantee that the service will be error-free, that results obtained from the service will be accurate, or that defects will be corrected. We are not responsible for content submitted by users.
Limitation of Liability
To the maximum extent permitted by applicable law, BRIVIO HQ LLC and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Brivio, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from your use of the service will not exceed the amount you paid (if any) to use Brivio in the twelve months preceding the claim.
Governing Law
These Terms will be governed by and construed in accordance with the laws of Missouri, without regard to its conflict of law provisions. Any disputes arising under these Terms will be resolved in the courts of Missouri, and you consent to the personal jurisdiction of such courts.
